The Occupant agrees to pay the Owner the Monthly Rent listed above. Monthly installments are payable in advance on or before the first of each month. If any monthly installment is not paid when due, or if any check is dishonored, the Occupant shall be deemed in default. Partial payments will not delay or stop foreclosure. Owner accepts checks, money orders and credit cards. Cash is accepted for walk-in payments only during business hours. DO NOT PUT CASH IN ANY MAIL SLOT OR DROP BOX.
If rent is not paid within five (5) days of the monthly due date, Owner may deny the Occupant access without notice. Access may also be denied for failure to supply written authorization, and may be conditioned to maintain order on the premises.
Late fee: $25 (after 5 days). Additional late fee if past 15 days. NSF fee: $25. Lock cut fee: $15. Cleaning fee: $25. Gate code removal: $10. All fees are deemed "additional rent."
Owner may enter the Space without notice to examine for violations, make repairs, or to comply with this Agreement, and may remove contents to another space at Occupant's expense.
Space shall be used solely for storage of personal property belonging to Occupant. No explosives, flammable, odorous, noxious, corrosive, or hazardous materials. No unlawful purposes. No jewels, furs, heirlooms, or irreplaceable items. NO HABITABLE OCCUPANCY of any kind. No business operations. Violations result in immediate termination.
Occupant accepts the Space as-is. Unit sizes are approximate. Costs to restore the Space to prior condition shall be borne by Occupant.
IN NO EVENT SHALL THE TOTAL VALUE OF ALL PROPERTY STORED EXCEED $5,000.00 UNLESS OWNER HAS GIVEN WRITTEN PERMISSION. THE MAXIMUM VALUE FOR ANY CLAIM OR SUIT BY OCCUPANT IS $5,000.00.
Either party may terminate with three (3) days written notice. Rent is not prorated. Occupant must remove all property on the day of termination. Owner may immediately terminate for breach, nuisance, criminal activity, or illegal use.
THE OWNER IS NOT A WAREHOUSEMAN AND NO BAILMENT IS CREATED. ALL PROPERTY IS STORED AT OCCUPANT'S SOLE RISK. OWNER AND OWNER'S EMPLOYEES SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGE TO PERSONAL PROPERTY FROM ANY CAUSE WHATSOEVER, INCLUDING BUT NOT LIMITED TO THEFT, MOLD, MILDEW, VANDALISM, FIRE, WATER, FLOOD, HURRICANES, TORNADOES, RODENTS, INSECTS, OR ACTS OF GOD.
THE OWNER DOES NOT PROVIDE ANY INSURANCE. IT IS THE OCCUPANT'S RESPONSIBILITY TO OBTAIN INSURANCE. Failure to carry required insurance is a breach of this Agreement. Occupant assumes all risk of loss to stored property.
All items of this Agreement are subject to change upon 30 days prior written notice (including email) to Occupant.
THE OWNER HAS A PRIVILEGE (LIEN) UPON ALL MOVABLE PROPERTY STORED AT THE FACILITY FOR RENT DUE AND ALL REASONABLE CHARGES. THE LIEN ATTACHES AS OF THE DATE PROPERTY IS BROUGHT TO THE FACILITY. OWNER SHALL HAVE THE RIGHT TO OVERLOCK THE UNIT AND DENY ACCESS ON THE FIFTH DAY AFTER THE DUE DATE IF RENT HAS NOT BEEN RECEIVED.
This Agreement constitutes a security agreement. Occupant may not assign or sublet the Space. Occupant agrees to pay attorneys' fees if Owner must enforce this Agreement. This Agreement binds heirs and successors.
This Agreement is governed by the laws of the State of Louisiana.
OWNER AND OCCUPANT HEREBY WAIVE THEIR RESPECTIVE RIGHTS TO TRIAL BY JURY OF ANY CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS RENTAL AGREEMENT.
NO EXPRESS OR IMPLIED WARRANTIES ARE GIVEN BY OWNER. OCCUPANT ACCEPTS THE SPACE AS IS AND WITH ALL FAULTS. OWNER'S ORAL STATEMENTS DO NOT CONSTITUTE WARRANTIES.
Occupant agrees to all posted Rules and Regulations. All notices may be sent by email. Owner may share info as required by law. Military service members must provide written notice. Owner and agents are not liable for personal injury. Owner does not guarantee security of personal/financial information. Climate-controlled spaces do not guarantee constant temperature. Occupant consents to calls, texts, and emails from Owner. Vehicles may only be stored per separate addendum.
Occupant must keep the Space locked with their own lock. DOUBLE LOCKING IS PROHIBITED. Occupant assumes full responsibility for all persons with key access.
Occupant shall indemnify and hold Owner harmless from all claims. Default on any one Space constitutes default on all Spaces rented by Occupant.
ALL CLAIMS AND DISPUTES SHALL BE SUBMITTED TO BINDING ARBITRATION ON AN INDIVIDUAL BASIS. OCCUPANT WAIVES THE RIGHT TO JURY TRIAL, CLASS ACTION, AND LITIGATION IN COURT IF OWNER ELECTS ARBITRATION. Arbitration conducted by NAM under its Self-Storage Industry Rules (namadr.com).
Owner may deny access during emergencies or inclement weather. Abusive or harassing conduct by Occupant is grounds for immediate termination.
Occupant agrees that an electronic signature has the same legal force and effect as a written signature. No third-party certification is required. Occupant certifies they are age 18 or above.
Type your full legal name exactly as entered on the previous step. Under Paragraph 38, this electronic signature is legally binding.
Accurate Storage LLC is offering an automatic payment option. With this option, your monthly payment will automatically be withdrawn from your credit card account on the 1st day of each month.
I understand that I may terminate this agreement by giving written notice to the Company, allowing a reasonable amount of time for the Company to act upon it. Additional service charges may apply if payment is returned due to insufficient funds.
